️⛳ Pursuant to Decree 78/2015/ND-CP, a household business is run by an individual or a group of people including individuals who are Vietnamese citizens who are full 18 years old, have full civil act capacity, or a household-owned, may only register their business at one location, have less than ten employees and be responsible with all their assets for business activities, including:

  • Households engaged in agriculture, forestry, fishery, salt production, and those selling street goods, snacks, trips, mobile businesses, and service providers with low incomes are not required to register their business, except for business in conditional industries and trades. The People's Committees of the provinces and centrally-run cities shall stipulate the low-income levels applicable in the locality.
  • Business households that regularly employ ten or more employees must register for business establishment in accordance with regulations.


Procedures for registration of establishment of a business household:

  ✨Individuals and household members who are Vietnamese citizens from the age of 18, have the full legal capacity and civil act capacity, have the right to establish business households, and are obliged to register business households according to regulations.

  ✨Pursuant to Clause 1, Article 82 of Decree No. 01/2021/ND-CP, a business household registration certificate may only be granted to a business household that meets the following conditions:

▪️ Business registration lines and trades are not banned from business investment;

▪️ The name of the business household must comply with the provisions of Article 88 of this Decree, specifically:

▪️ The name of a business household consists of two elements in the following order: the phrase "Household Business" and the proper name of the business household. The proper name is written with the letters of the Vietnamese alphabet, the letters F, J., Z, W, can include numbers, symbols.

▪️ Do not use words or symbols that violate the historical, cultural, ethical, and fine traditions of the nation to name a business household.

▪️ Business households are not allowed to use the terms "company", "enterprise" to name the business household.

▪️ The proper name of a business household must not coincide with the proper name of a business household registered within the district.

▪️ Have a valid business household registration dossier;

▪️ Fully pay the business household registration fee as prescribed

License fee: According to Decree No. 139/2016/ND-CP, Decree No. 22/2020/ND-CP, and Circular No. 65/2020/TT-BTC, the license fee rate for households Business is calculated based on the average annual revenue.

⭕ Value added tax (VAT) and personal income tax (PIT) of business households are calculated by the presumptive method. A flat tax is a fixed monthly/quarterly tax payable by individual business households; The flat tax rate is determined by the tax authority based on the declared information/actual revenue from business activities.

In Circular 88, the Ministry of Finance stipulates that the arrangement of accountants shall be decided by the representative of business households and individuals. The representative of a business household or business individual may arrange his or her biological father, mother, adoptive father, adoptive mother, wife, husband, biological child, adopted child, brother, sister, or younger brother as an accountant for the household. business people, business individuals, or appointing people to act as managers, executives, storekeepers, cashiers, people who are assigned the task of regularly buying and selling assets to concurrently act as accountants for business households and individuals.
